In DeKalb County School District, we are committed to ensuring that every student has the opportunity to succeed, regardless of physical or mental disabilities. As part of our commitment, we follow the guidelines of Section 504 of the Rehabilitation Act of 1973 to eliminate barriers and provide equal access to educational programs and services.

What is Section 504?

Section 504 is a federal law that protects the rights of individuals with disabilities in programs and activities that receive federal financial assistance, including public schools. It ensures that students with disabilities are given the accommodations and support necessary to access the general education curriculum and participate fully in school activities.

Who Qualifies for Section 504?

Students who have a physical or mental impairment that substantially limits one or more major life activities may be eligible for accommodations under Section 504. Major life activities include, but are not limited to, learning, walking, communicating, seeing, hearing, and breathing.
Unlike special education services, which are provided under the Individuals with Disabilities Education Act (IDEA), Section 504 focuses on providing accommodations that allow students to access the same educational opportunities as their peers.

How Does Section 504 Help My Child?

If your child qualifies for a Section 504 Plan, the school will work with you to develop accommodations tailored to their specific needs. These accommodations are designed to remove barriers and allow your child to succeed in the classroom. Accommodations may include:

  • Adjustments in the classroom environment or teaching methods.
  • Modifications to testing procedures.
  • Assistance with mobility or communication needs.
  • Specialized equipment or technology.

These supports help ensure that your child can thrive academically, socially, and emotionally, despite any challenges related to their disability.

The Section 504 Process

The process of establishing a Section 504 Plan begins with a a referral and an evaluation. If you or your child’s teacher believes that your child has a disability, requiring accommodations, you can request an evaluation. This data review will determine whether your child has a disability under Section 504 and how it impacts their learning and participation in school activities.

Once eligibility is determined, a team of educators, specialists, and you as the parent will collaborate to create a personalized 504 Plan. This plan will outline the specific accommodations your child will receive, and the school will regularly review and update it as needed.

Your Role as a Parent

As a parent, you play an important role in advocating for your child’s needs. We encourage you to be actively involved in the evaluation process and the development of the 504 Plan. Your insights into your child’s strengths, challenges, and experiences are vital to ensuring that the plan meets their unique needs.
Open communication between you and your child’s teachers and school staff will help ensure that the 504 Plan is implemented successfully and adjusted as necessary to support your child’s progress.

Resolving Concerns

We understand that questions or concerns may arise regarding your child’s 504 Plan or its implementation. Our goal is to work together with you to resolve any issues at the school level. Should you have any concerns, we encourage you to first speak with your child’s 504 Chairperson or principal. Additional support is available at the district level, where our 504 team can provide guidance and assistance.
If needed, there are further options, including mediation, impartial hearings, and filing a complaint with the Office for Civil Rights (OCR), to ensure that your child’s rights under Section 504 are upheld.
